Almia (ABN 25 380 435 979) is based in Sydney, New South Wales, Australia.
These Terms and Conditions govern your use of the Almia website (almia.com.au, almia.au) and your purchase of personalised children’s books through our platform. By using our website or placing an order, you agree to these terms.
1. About Our Service
Almia creates personalised, illustrated children’s storybooks. Parents and caregivers provide information about their child, including a name, nickname, age, interests, personality traits, and optionally a photograph. Our platform uses this information to generate a unique story and original illustrations, which are then printed as a premium hardcover book and delivered to you. No two books are identical. Each book is tailored to the child it’s made for. Before you purchase, you will have the opportunity to preview every illustration and regenerate any image you’re not happy with. The book that arrives at your door is the book you approved. Minor variations in colour reproduction and print finish may occur between what is displayed on screen and the final printed product, as is standard with any print-on-demand product.
2. Eligibility
You must be at least 18 years of age to use our website and place orders. By placing an order, you confirm that you are a parent, legal guardian, or authorised caregiver of the child for whom the book is being created, and that you have the authority to provide the child’s personal information and photograph (if applicable) for the purposes described in these terms and our Privacy Policy.
3. Orders and Payment
3.1 Placing an Order
When you place an order through our website, you are making an offer to purchase a personalised book. We will confirm acceptance of your order by email. A binding contract is formed when we send this confirmation.
3.2 Pricing
All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Shipping costs are calculated and displayed at checkout before you complete your purchase. We reserve the right to update prices at any time, but changes will not affect orders that have already been confirmed.
3.3 Payment
Payment is processed securely through our payment provider. We do not store your credit card details on our servers. By providing your payment information, you confirm that you are authorised to use the payment method and that the information provided is accurate.
4. Personalisation and Content
4.1 Information You Provide
The quality and accuracy of your personalised book depends on the information you provide during the ordering process. Please review all details carefully before submitting your order. We are not responsible for errors in the final book that result from incorrect or incomplete information provided by you.
4.2 Photographs
If you upload a photograph of your child, you confirm that you own the photograph or have permission to use it, and that you consent to its use in generating illustrations for the book. Photographs are used solely for the purpose of creating your personalised book and are handled in accordance with our Privacy Policy.
4.3 AI-Generated Content
Stories and illustrations in your book are generated by artificial intelligence. The content is not created by a human author or illustrator. While we implement safety filters and quality controls, AI-generated outputs may occasionally contain minor imperfections or unexpected variations. AI-generated illustrations aim to reflect the child’s described or photographed appearance but may not achieve a photographic likeness. You will have the opportunity to preview and approve all illustrations before purchase (see Section 4.4).
4.4 Preview and Approval
Before you purchase your book, you are given the opportunity to preview the complete set of AI-generated illustrations. You may choose to regenerate any individual illustration if you are not satisfied with it. Payment is only taken after you have reviewed and approved the final content. By completing your purchase, you confirm that you have reviewed the illustrations and are satisfied with the book as presented.
4.5 Content Review and Safety
All generated content passes through automated safety filters designed to ensure age-appropriateness. We reserve the right to reject or modify any order if the inputs provided could result in content that is inappropriate, offensive, or harmful.
5. Production, Shipping and Delivery
5.1 Production
Books are printed on demand by our print partners. Production typically takes 5 to 7 business days from order confirmation. Production times may vary during peak periods.
5.2 Shipping
We ship to addresses within Australia and New Zealand. Estimated delivery times are provided at checkout and are indicative only. Standard shipping within Australia is typically 2 to 5 business days after dispatch. Delivery to New Zealand may take longer depending on customs processing. We are not responsible for delays caused by postal services, customs authorities, incorrect delivery addresses provided by you, or events outside our reasonable control.
5.3 Risk and Title
Risk of loss or damage to your book passes to you upon delivery to the address you specified. Title to the book passes to you upon receipt of full payment.
6. Refunds, Returns and Consumer Guarantees
6.1 Australian Consumer Law
Our books come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 New Zealand Consumer Guarantees
If you are purchasing from New Zealand, your rights under the Consumer Guarantees Act 1993 (NZ) apply. Goods must be of acceptable quality, fit for their intended purpose, and match their description.
6.3 Defective or Damaged Products
If your printed book arrives damaged, has significant print defects, or does not match the content you previewed and approved, please contact us within 14 days of delivery via the chat bubble in the corner of the page. Send us your order number and a photograph of the issue. We will assess the problem and provide a remedy in accordance with applicable consumer law, which may include a replacement book or a full refund.
6.4 Personalised Products and Change of Mind
Because each book is custom-made to your specifications, and because you are given the opportunity to preview and approve all illustrations (including the option to regenerate individual images) before completing your purchase, we do not offer change-of-mind returns or refunds. By completing payment, you confirm that you reviewed and approved the book’s content. This does not affect your statutory rights under the ACL or the NZ Consumer Guarantees Act. If the printed book does not match the content you approved, or is not of acceptable quality, you remain entitled to a remedy.
6.5 Refund Method
Where a refund is provided, it will be processed to the original payment method within 10 business days of approval. For full details, please see our Refund and Returns Policy.
7. Intellectual Property
7.1 Your Content
You retain ownership of the photographs and personal information you provide to us. By submitting content to Almia, you grant us a non-exclusive, worldwide, irrevocable, royalty-free licence to use, process, and store that content for the following purposes: • Creating and delivering your personalised book, including transmitting the content to our service providers (such as AI processing and print fulfilment partners). • Retaining your book file in your account to enable reprints and customer support. • Using completed books (with identifying details removed or with your prior consent) as portfolio samples, marketing examples, or product demonstrations. This licence does not transfer ownership of your photographs to us. You remain free to use your photographs however you wish. The licence is limited to the purposes listed above and does not permit us to sell your photographs or use them for any unrelated purpose.
7.2 Generated Content
All stories, illustrations, and book designs generated through the Almia platform are original works created by our systems, not derivative works of your photographs or inputs. Almia (or its licensors) owns all rights in the generated content. Your photographs and profile information are used as reference inputs, but the generated output is a new and independent creation. When you purchase a book, you receive a personal, non-commercial licence to enjoy the physical book and its contents. You may share and display your book privately (for example, reading it to your child or showing it to family and friends). You may not reproduce, distribute, or commercially exploit the content of your book without our written permission.
7.3 Almia Brand
The Almia name, logo, and associated branding are trademarks of Almia (trademark application pending with IP Australia). You may not use our trademarks without written permission.
8. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law and the NZ Consumer Guarantees Act: • Our total liability for any claim arising from or related to your order is limited to the amount you paid for that order. • We are not liable for any indirect, consequential, or incidental loss or damage, including loss of data, loss of profit, or emotional distress, except where such liability cannot be excluded by law. • We do not warrant that AI-generated content will be free from all imperfections or that illustrations will achieve a photographic likeness of any individual.
9. Privacy
We collect, use, and handle your personal information in accordance with our Privacy Policy, which forms part of these terms. Please read our Privacy Policy carefully before providing any personal information or placing an order.
10. Acceptable Use
You agree not to use our website or services to: • Provide false, misleading, or offensive information. • Upload content that infringes the rights of any third party. • Attempt to interfere with the operation of our website or services. • Use our service for any unlawful purpose. We reserve the right to refuse or cancel any order if we reasonably believe these terms have been breached.
11. Governing Law and Disputes
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services will be subject to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in these terms limits your right to bring proceedings in another jurisdiction if permitted by law. If you have a complaint, please contact us via the chat bubble in the corner of the page. We will make reasonable efforts to resolve your complaint within 14 business days. If we cannot resolve the matter, you may contact NSW Fair Trading or the relevant consumer protection agency in your jurisdiction.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
